We are experienced in providing services to insurers and related organisations, such as the drafting and evaluation of insurance terms and conditions and of insurance contracts, including group policies. We are also highly experienced in drawing up agreements for insurance brokers and other intermediaries, and in assisting with the setting up of such businesses (for example, obtaining a broker’s licence).
Lawyers from our firm have had experience in conducting administrative proceedings before the Financial Supervisory Commission. Subjects of these proceedings have included the establishment of a Polish branch of a foreign insurance company, and changes in the scope of operations of a Polish insurer.
One of the main fields of law in which we specialise is employment law, broadly construed. We advise our clients both when concluding contracts – including selection of the optimum legal form of employment (employment contract or freelance work agreement) – and when amending or terminating such contracts. We have assisted in restructuring processes carried out by our clients, including group redundancy procedures. We have drafted employment-related internal regulations (rules on employment, remuneration and bonuses, rules for company social benefit funds) for many firms.
In providing legal assistance, we also assist employers in negotiations with trade unions and other staff representatives.
Lawyers from our firm have many years of experience in handling all stages of litigation, including proceedings before the Polish Supreme Court. We have conducted numerous cases in fields including employment law, insurance law, medical errors, intellectual property rights and unfair competitive practices.
In situations where we consider it to be in our clients’ interests, we recommend steps to settle disputes out of court through negotiation or mediation.
To ensure that our clients receive a full range of services, we also provide legal assistance in relation to personal data protection, both as an important element in the contracts that we evaluate, and as a requirement in the proper organisation and operations of a business. We are experienced in drafting and evaluating legally required documents relating to personal data, such as security policies, computer system management instructions, authorisations to process data, etc.
On behalf of our clients we file applications to the General Inspectorate of Personal Data Protection (GIODO) for the registration of data sets or of information security administrators. We also carry out audits for clients to check that they are complying with current legal requirements concerning data protection.
Our firm provides its clients with legal assistance in all matters relating to the provision of medical services. We not only assist in setting up medical practices and adapting the client’s needs to the legally permitted forms for such operations, but also draft all kinds of documents – organisational rules, statutes, etc. – related to medical service provision. On behalf of clients, using an electronic application, our firm will handle the registration of medical service providers and all required changes to their registration details.
Lawyers from our firm also provide comprehensive legal assistance in all matters relating to employment and to work carried out for medical service providers, both under employment contracts and freelance agreements, taking into consideration all regulations concerning medical personnel.
We also provide day-to-day assistance to medical service providers in relation to all legal matters, including the rights of insured persons, patient rights, performance of contracts with the National Health Fund (NFZ) and inspections. We represent providers in court proceedings relating to their medical practices, primarily in cases concerning alleged medical errors.
We deal with matters concerned with copyright and related legal rights. We draft or evaluate copyright assignment agreements and licence agreements for our clients, including in relation to computer software, ensuring that the financial provisions and permitted fields of use are correctly defined
We are aware that for many firms the development of successful relations with customers, particular when they are consumers, may be a matter of key importance.
We are highly experienced in defining legal relations between businesses and consumers, ensuring that the firm’s interests are protected while at the same time the consumers’ rights are not violated. We pay particular attention to the need to construct agreements so as to avoid clauses that might be deemed impermissible.
We are experienced in preparing specimen contracts, and in matters relating to the use of remote means of communication in consumer relations (for example, rules on the provision of services by electronic means) and to the handling of customer complaints.
Lawyers from our firm are also experienced in other areas of law, such as issues relating to unfair competitive practices.
We provide assistance to our clients in day-to-day administrative and organisational matters. We also evaluate all types of agreements required in the normal operation of a business, including contracts with suppliers and rental and leasing agreements.
In addition to the services described above, we provide professional training in a range of areas of law, particularly when such training is required by our clients.
We have given lectures at the Economics Faculty of the University of Warsaw, for postgraduate students taking a course in healthcare risk management. This experience means that we are able not only to provide our clients with legal assistance, but also to educate members of their staff so as to improve their skills and the quality of their work.
